Welcome to KN Website Designs! These terms and conditions, including our agreement, govern your use of our website and the purchase of our packages. By accessing our website and making a purchase, you agree to be bound by these terms and conditions as well as our agreement below. Please read them carefully.
1. Website Use
a. You must be at least 18 years old to use our website.
b. You may not use our website for any illegal or unauthorized purpose.
c. You must not transmit any worms, viruses, or any code of a destructive nature through our website.
2. Package Information
a. We strive to provide accurate and up-to-date information about our packages, including descriptions and pricing. However, we do not warrant that the information is error-free or complete.
3. Payment
a. By placing an order, you are offering to purchase a package and agree to the price specified. Please note: there may be additional fees such as taxes and Wix fees.
b. We reserve the right to refuse or cancel any orders at our discretion.
c. Payment must be made in full before we start working on your website.
4. Completion
a. We will make reasonable efforts to ensure that your website is completed in a timely manner. However, we are not responsible for any delays caused by weather, illness, or other unforeseeable circumstances.

5. Refunds
a. We do not do refunds, all sales are final.
6. Intellectual Property
a. All intellectual property rights, including trademarks and copyrights, related to our packages and website are owned by KN Website Designs.
b. You may not use our intellectual property without our prior written consent.
7. Limitation of Liability
a. To the maximum extent permitted by law, KN Website Designs shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use or inability to use our packages or website.
8. Governing Law
a. These terms and conditions shall be governed by and construed in accordance with the laws of the state of Missouri, without regard to its conflict of laws provisions.
9. Amendments
a. We reserve the right to update or modify these terms and conditions at any time without prior notice. It is your responsibility to review them periodically.

Website Design Agreement
This Website Design Agreement (the “Agreement”) is made and entered into by and between:
Client:
The person or entity making payment for the website design package, as identified in the payment information provided through the KN Website Design website. (For clarity, the Client is the individual or organization whose payment for the selected package is processed through the Wix platform.)
Designer:

1. Project Overview
KN Website Design agrees to provide website design services to the Client as detailed in the selected package below. By making a payment for a package on the KN Website Design website, the Client affirms their agreement to the terms and conditions set forth in this Agreement.
Package Selection:
The Client acknowledges that they are selecting and agreeing to the package that corresponds to the payment made through the KN Website Design website. The package details and services included in the selected package will be as outlined on the website at the time of purchase.
By making a purchase, the Client confirms their acceptance of the terms of the selected package:
• I confirm that the package I have paid for through the KN Website Design website is the package I am agreeing to, and I accept the terms outlined in this Agreement.
2. Payment Terms
The Client agrees to pay the total amount for the selected package as indicated on the KN Website Design website.
Payment Method:
• Payment is made via the Wix platform: Payments for the selected package are processed through the Wix website, utilizing Wix’s card payment offerings.
• No Refunds: All payments are final and non-refundable. By making payment, the Client acknowledges and agrees that no refunds will be issued under any circumstances once the payment has been processed.
• Full Payment Due Before Work Begins: Full payment for the project is required before any work is started. The Designer will not begin work on the website until the full payment is processed.
3. Timeline
• Project Start Date: The project will begin after the full payment is processed and all necessary materials (photos, content, information, requests, etc.) that the Client wishes to have included on the website are received. The Client is responsible for ensuring all required materials are submitted in a timely manner to avoid delays.
• Client-Provided Materials: If the Client fails to submit all necessary materials (photos, content, requests, etc.) within seven (7) days of making payment, this may result in further delays to the project timeline. Due to the potential for overlapping client projects, any delay in receiving the required materials may extend the completion date beyond the original estimate.
• Unresponsiveness & Forfeiture of Payment: If the Client is unresponsive or unable to provide the necessary information, content, or materials needed to complete the website within one (1) month from the date of the payment, the Client’s project will be considered abandoned. In such cases, the Client will forfeit their payment, and no refund will be issued. At this point, the Designer will have no further obligations to the Client, and the project will be considered closed.
• Initial Project Completion Date: The Designer will aim to complete the initial website design within one month from the date that all necessary materials (content, instructions, and preferences) are provided by the Client.
• Edit Request Period: Once the initial website design is completed, the Client will have three (3) days from the initial completion date to request any changes or revisions to the website. If no changes are requested within this three-day period, it will be assumed that the Client is satisfied with the website as delivered, and the project will be considered complete. After this time, no further changes will be made unless additional payment is made for further revisions.
• Final Edits: If the selected package includes multiple rounds of edits, the Designer will require up to one month to implement the final set of changes after receiving the last round of edits from the Client.
• Delays Due to Client-Provided Materials: Any delays in receiving the necessary materials or instructions from the Client may result in an extension of the timeline.
4. Revisions
The number of revisions provided will depend on the package selected by the Client. Any revisions beyond those specified in the selected package will incur a fee of $85 per hour (subject to change). This fee will be charged in advance, based on the Designer’s estimated time to complete the revisions. The Client will be informed of the estimated time required for the revisions prior to payment.
5. Ownership & Copyright
Upon full payment, the Client will own the rights to the website design and its content. The Designer retains the right to showcase the website in their portfolio and on their website.
• Wix Account: The Client is responsible for maintaining a valid Wix account. If the Designer assists in setting up these services, this will be treated as an additional charge.
• Content Ownership: The Client affirms that they have all necessary rights to any content (text, images, logos, etc.) provided to the Designer and that the Designer is not liable for any infringement.
6. Client Responsibilities
The Client agrees to provide all necessary content (text, images, videos) for the website in a timely manner. The Client is also responsible for providing clear instructions regarding design preferences and functionality.
7. Hosting and Domain
The Client will be responsible for purchasing and maintaining any domain name and hosting services required for the website. If the Designer assists in setting up these services, this will be treated as an additional charge.
8. Warranty & Support
The Designer provides a seven (7) day warranty period after the website launch to fix any design errors arising from issues such as non-functioning links, broken buttons, or other technical design errors that affect the functionality of the website.
Please note that the warranty does not cover changes to the aesthetic look or design of the website. If the Client requests changes to the overall design, layout, or visual elements after the website is launched, these requests will be treated as revisions and subject to additional charges.
After the seven-day period, any additional maintenance or support services will be subject to an additional fee.
9. Limitation of Liability
The Designer will not be held liable for any damages or losses resulting from the use of the website once it is delivered. The Client agrees to hold the Designer harmless for any third-party issues arising from the website after completion.
10. Governing Law
This Agreement will be governed by and construed in accordance with the laws of the state or country where the Designer resides.
11. Attorney Fees and Court Costs
In the event of any legal action or dispute arising from this Agreement, the Client agrees to be responsible for all attorney fees, court costs, and other legal expenses incurred by both the Client and the Designer in connection with the dispute, regardless of the outcome.
12. Severability
If any provision of this Agreement is deemed invalid, illegal, or unenforceable by a court of law, the remainder of the Agreement shall remain in full force and effect. The invalid provision will be amended to reflect the parties’ intent as closely as possible.
13. Preparation
Both parties fully agree with the contents of this Agreement. In the event of any dispute or disagreement involving the construction or interpretation of this Agreement, no inference shall be drawn from the fact that one party had principal responsibility for its preparation.
14. Parties Bound
This Agreement is binding upon and inures to the benefit of the parties hereto and their respective successors, assigns, and legal representatives.
15. Limitation on Actions
Any legal action arising from this Agreement must be initiated within six (6) months from the date of the occurrence of the event giving rise to the claim. After this period, no legal action can be initiated or maintained.

17. Entire Agreement
This Agreement constitutes the entire understanding between the Client and the Designer. Any amendments to this Agreement must be in writing and signed by both parties.
18. Conclusion
By completing the payment, the Client acknowledges and agrees to all terms and conditions outlined in this Agreement.
